Judge denies NCAA’s motion to dismiss IU safety's case, Louis Moore eligible for the remainder of season

A judge denied the NCAA’s motion to dismiss Moore’s eligibility lawsuit, the senior safety will play his last full season in Bloomington

Judge Dale Tillery of the Dallas County 134th Civil District Court denied the NCAA’s motion to dismiss Indiana safety Louis Moore’s eligibility lawsuit during a hearing Wednesday, to remain eligible the rest of the 2025 season.

Michael Niziolek of the Indiana Herald-Times first reported the denial on X

“This Court is of the opinion that Moore is entitled to the issuance of Temporary Injunction and that such an Order is necessary to protect Moore’s rights and interests,” Tillery wrote.  “This Order is necessary because of the immediate need to allow Moore to play football for Indiana for the 2025-26 season, in order to prevent irreparable harm to Moore’s career-including development with the Team, the opportunity to play with the Team, and the opportunity to effectuate his NIL deal.”

Moore is eligible for the entire 2025 season, which will be his last season of his collegiate career.

Louis Moore added his name to the ever-growing list of FBS players who are suing the NCAA for another year of eligibility under the newly created “Diego Pavia Rule,” which grants a blanket waiver of eligibility to JUCO transfers.

According to Louis Moore's lawsuit and his attorney Brian Lauten, Moore would lose out on a “one-in-a-lifetime” name, image, and likeness contract worth $400,000 if he wasn't allowed to play in 2025, and miss an opportunity to “enhance his career and reputation by playing another year of Division I football at an NCAA major conference university that likely extends beyond the direct financial returns.”

The seventh-year senior started his college career at (Navarro Junior College) in 2019 where he spent three years.  He then played at Indiana in 2022-23 under Tom Allen before transferring to Ole Miss in 2024, and he returned to Bloomington this year for his final chapter.

"I commend our judge," Lauten told ESPN "He carefully listened to the evidence, he let everybody put on their case, and this result is a righteous result for a very deserving client. The students at Indiana, the faculty at Indiana, the fan base at Indiana - they should really be proud of Louis. He is an asset to their school."

Moore leads Indiana with 23 tackles, and he’s the team’s co-leader with two interceptions.

No. 11 Indiana travels to take on the Iowa Hawkeyes on Saturday for a 3:30 p.m. kickoff on Peacock.
